Terms & Conditions – For Bespoke and Engraved Jewellery by Found Treasure
“Bespoke jewellery” means any item of jewellery that is created by us in accordance with the customer’s specifications, or an original model that is customised based on the customer's input. Special terms and conditions apply to such purchases. Found Treasure Jewellery reserves the right to revise the terms and conditions at any time. Users are responsible for keeping themselves updated on any changes. By placing an order for bespoke, made to order or engraved jewellery, you confirm that you have read and accepted the below Terms and Conditions and our Privacy Policy.
Design Process and Payment
The design process, sourcing and sketches begin after the customer has paid the design service fee. Payment should be made by VISA, Mastercard through a payment link and Invoice provided by Found Treasure Jewellery. The total will be shown in UK pounds £’s on Found Treasure Jewellery’s website. As stated, the design service is a one off payment and is a non-refundable fee.
The design development and production begin after the customer has paid the full Invoiced amount or agreed upon payment terms stated via email and invoice. Payment total will be shown in UK pounds £’s and the amount received should equal the total in UK pounds, if payment is made in a different currency. Payments made are non-refundable.
Timelines and Client Collaboration
Timelines for the creation of bespoke jewellery are time-sensitive and subject to the mutual cooperation of both the client and the designer. As our creative process is a collaborative effort, it is essential that the client responds to design inquiries, approvals, or requests for information in a timely manner. Failure to do so may result in delays, and the client understands that such delays may affect the achievement of the agreed-upon deadlines. The client acknowledges that the timeline provided is contingent upon timely communication and collaboration, and any delays in response may result in a revised delivery schedule.
Timelines will vary depending on the complexity of the item, and the time required by Found Treasure Jewellery and the maker to create the jewellery. Delivery time will be agreed with each individual customer. Delays may occur for different reasons, but we will do our best to keep the customer informed about changes to the delivery schedule. Found Treasure Jewellery shall be under no liability for any delay in delivery or non-delivery due to circumstances beyond our control (i.e. delays in transportation by Royal Mail, DHL, FEDEX or other external providers.)
Returns and Resizing
Bespoke and engraved items are considered special orders and they are not eligible for returns or exchanges. If the damage or error was present upon arrival, Found Treasure Jewellery reserves the right to repair or adjust the product so it fits with the initial agreement with the customer. A resizing or alteration service is available depending on the item and technique in question and this service may incur a fee of £40 or more plus insured postage costs. If we cannot measure your ring size for you, we strongly recommend that measurements are taken by a professional jeweller. Found Treasure Jewellery is not responsible for any inaccuracy with regards to measuring and sizing.
Deposits and Non-Refundable Fees
A payment is required to secure the bespoke jewellery service. All payments are non-refundable as the service has already been initiated upon receipt of payment. By making a deposit, the client acknowledges and agrees that the fee is non-refundable, as work on the design or production process has already commenced or been completed. In the event of cancellation, the deposit will not be refunded, regardless of the stage of the work.
In the event of cancellation of a bespoke or commissioned order with stipulated payment terms during the production phase, all agreed-upon final payments remain due and payable.
Design and Copyright
Once a design idea (manifested in an image/sketch combined with written correspondence) has been agreed on, the client has to honor this agreement. Found Treasure Jewellery cannot be held accountable for changes to personal views on the original idea after work on the piece has commenced. We will match the design or sketch as closely as possible when translated into your jewellery item, but please bear in mind that any sketches are just an indication of how the finished jewellery will look. Since the jewellery is hand-made, some variations from the sketch to the final, finished item can occur.
All designs, encompassing those within the standard collection and bespoke commissions, constitute the intellectual property of Found Treasure Jewellery and are protected against unauthorised copying, reproduction, modification, or adaptation. The copyright for all designs shall at all times remain vested in Found Treasure Jewellery, and clients are expressly prohibited from replicating any design elements for any purpose whatsoever.
Use of Photos and Making Process
By confirming these terms and conditions, you grant us the right to use any tagged photos of your bespoke jewellery for marketing purposes, including but not limited to social media, websites, and promotional materials. Additionally, we reserve the right to share images or videos of the making process of your piece, unless you explicitly request otherwise in writing. However, if your commission is an engagement ring, we will not share any images or videos of the making process during its creation to maintain the surprise and privacy for the recipient. If you prefer that your jewellery and its creation process remain private, please notify us at the time of order or prior to any sharing.
Insurance Recommendation
We highly recommend that clients insure their bespoke jewellery piece if its value exceeds £1000. Insurance coverage will provide peace of mind and facilitate collaboration between both parties should the piece need replacement, repair, or any form of restoration. While we take every precaution to ensure the safety and quality of your jewellery, insurance is strongly advised to protect your investment.
